A DCS adoption happens when a child becomes a ward of the state due to concerns about neglect, abuse, or the absence of a safe, stable caregiver. During this time, parents are given a case plan designed to address the issues that brought the child into care—such as counseling, substance abuse treatment, parenting classes, or supervised visitation.
If the parents meet their goals, the child may be returned home. But when they fail to make sufficient progress, and parental rights are terminated, the state allows the child to be adopted by a relative or foster placement.

What Is a DCS Adoption?
DCS initiates an investigation when allegations of abuse or neglect are made. If the investigation finds evidence of unsafe conditions, the child may be removed from the home. The parents then receive a case plan with specific requirements they must complete to work toward reunification.
During this period, the court holds regular hearings to monitor progress. If a parent does not comply or the court finds that reunification is no longer in the child’s best interest, the court may terminate parental rights, opening the door to adoption.

Arizona law protects constitutional parental rights, including the right to raise, educate, and discipline one’s child. However, these rights do not permit abuse, neglect, or unsafe conditions.
